SUBJECT: Clergy and Attorney Visits


Reference is made to my August 9, 1995 memo regarding Clergy and Attorney Visits where, on page 2, I stated that it is appropriate for attorneys (or the attorney's representative, legal paraprofessional or law clerk) to take legal materials and writing instruments as needed into the visiting room for an attorney visit.

At this time, I am providing a more precise list of the allowable items that attorneys may bring into the visiting room:

(1) Legal papers, including the attomey's file on the prisoner's case, e.g., correspondence, pleadings, transcripts, etc.

(2) Writing pads and implements (pen and/or pencil).

(2) Softbound copies of law books (e.g. Michigan Court Rules; compilation of criminal statutes; sentencing guidelines).

In addition, in unique cases a tape recorder, video camera, or other equipment may be needed. However, it should be made clear that such items require prior approval by the warden's office and will not be routinely allowed. Also, it should be made clear that all items are subject to being searched.

I trust this memo will now clarify any questions on this matter.
