Michigan Supreme Court grants new trial because of errors associated with use of peremptory strikes
People v Yarbrough, MSC No. 16153 (July 14, 2023)
On July 14, the The Michigan Supreme Court issued its opinion in People v Yarbrough, holding that "the erroneous denial of a defendant’s peremptory challenge is subject to automatic reversal when the error is preserved and no curative action is taken." The Court granted Mr. Yarbrough a new trial.
