Marcel S. Benavides won a suppression motion – leading to a dismissal with prejudice – in the 6th Judicial (Oakland County) Circuit Court in a felony drug possession case; a pre-trial motion to suppress was granted after the circuit judge reviewed the car video and saw that the client’s brake-lights, contrary to the allegation of the arresting officer, were functioning at the time of the stop.
