6th Judicial Circuit of Michigan - Oakland County

The Circuit Court is a division of the state judiciary and serves as a trial court of general jurisdiction serving all the citizens of Oakland County.

It hears both civil and criminal cases, as well as appeals from the District Court, Probate Court and administrative agencies. The Court has sole and exclusive jurisdiction on certain matters involving the family.

Civil/Criminal Division (Overview)

The Civil/Criminal Division of the Oakland County Circuit Court was developed in coordination with the Family Division in 1998. All cases under the jurisdiction of Circuit Courts that were not specifically dedicated to the Family Division under PA 338 of 1996 were assigned to the jurisdiction of this new division.

The Fourteen Elected Judges within the Civil/Criminal Division handle:
Civil cases valued over $25,000
Felony criminal cases
Appeals from courts of lesser jurisdiction and administrative agencies
Adult Treatment Court

Family Division

The Family Division of the Circuit Court was created by Public Act 388 of 1996.  On January 1, 1998, family matters handled previously by the Circuit and Probate Courts in Oakland County became consolidated under the new Family Division of the Circuit Court, creating a place where a family could go with all of its legal problems. Family Division cases involving a single family are assigned to a judicial team consisting of the judge, referees, case assistants, and family counselors.

Criminal Assignment System

The Criminal Assignment System is overseen by the Criminal Assignment Committee.  This committee is comprised of five Circuit Court judges and five attorneys.  The Committee meets bi-monthly, or at the discretion of the chairperson, to review new applications.  Questions regarding the Criminal Assignment System should be directed to the Court Administration Office at (248)452-2159.

Adult Treatment Court

The Adult Treatment Court applies alternative judicial proceedings to chemically abusing, non-violent adult felony offenders, in an effort to rehabilitate and then successfully reintegrate them into the community.

Following a thorough assessment to confirm serious abuse or addiction, a customized treatment and rehabilitative plan is developed for each participant. In addition to regular therapy to rectify substance abuse, participants are subjected to frequent random drug and alcohol screens. Bi-weekly meetings with the probation officer, sessions with the judge, and mandatory attendance at AA or NA meetings are also required. Graduated sanctions are employed when a participant does not comply with court expectations.

In addition to the reward of avoiding incarceration, various incentives for constructive action are built in to facilitate and publicly acknowledge participant progress.
